Limited Liability Warranty
Dura Sleeve Inc. (“Manufacturer”) warrants the Durasleeve (“Product”) to the original purchaser (“Purchaser”) against manufacturing defects for a period of one year from the date of purchase, provided that the Purchaser can provide proof of purchase. This Limited Liability Warranty is subject to the following terms and conditions:
- Coverage: This Limited Liability Warranty covers defects in materials and workmanship of the Product. The Manufacturer, at its sole discretion, will provide either a new replacement Product or refund the purchase price to the original Purchaser upon verification of the defect.
- Exclusions: This Limited Liability Warranty does not cover damages or defects resulting from misuse, abuse, accident, negligence, improper installation, alteration, or any other use of the Product not in accordance with Manufacturer’s instructions.
- Procedure: To make a warranty claim, the Purchaser must promptly notify Dura Sleeve Inc. in writing within the warranty period. The Purchaser must provide proof of purchase and describe the alleged defect in detail. Upon receipt of the claim, the Manufacturer may request additional information or evidence to assess the claim.
- Limitation of Liability: The liability of Dura Sleeve Inc. under this Limited Liability Warranty is expressly limited to the replacement or refund of the defective Product as provided herein. In no event shall the Manufacturer be liable for any incidental, consequential, or indirect damages arising from the use or inability to use the Product.
- Non-transferable: This Limited Liability Warranty is non-transferable and applies only to the original Purchaser of the Product.
- Installation: This Limited Liability Warranty shall be void if the Product has been installed. It is the Installer’s responsibility to inspect the Product for defects before installation.
- Governing Law: This Limited Liability Warranty shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of laws principles.
- Entire Agreement: This Limited Liability Warranty constitutes the entire agreement between the Manufacturer and the Purchaser regarding the warranty of the Product, and supersedes all prior and contemporaneous agreements and understandings, whether written or oral.
By purchasing the Durasleeve product, the purchaser acknowledges and agrees to be bound by the terms and conditions of this Limited Liability Warranty.
